Terms of Service

By downloading, installing, or using the Omnutrient application or website (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Your continued use after changes constitutes acceptance of the updated Terms.

Omnutrient is a personal nutrition and wellness platform that provides:

• AI-powered nutrition tracking and meal logging
• Food recognition via photo scanning and barcode lookup
• Personalized nutrition insights, analytics, and goal tracking
• AI nutrition assistant for dietary guidance
• Integration with Apple HealthKit and third-party fitness services
• Exercise and workout tracking
• Supplement tracking

The Service is provided for informational and wellness purposes only. Omnutrient is not a medical device and does not provide medical advice, diagnosis, or treatment.

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You must be at least 13 years old (or the minimum age in your jurisdiction) to create an account and use the Service.

Omnutrient offers both free and premium subscription tiers. Premium features require an active paid subscription.

• Subscriptions are billed on a recurring basis (monthly or annually) through Stripe or Apple In-App Purchases
• You may cancel your subscription at any time; access continues until the end of the current billing period
• Refunds are handled in accordance with the applicable payment platform’s policies (Apple App Store or Stripe)
• We reserve the right to change subscription pricing with reasonable notice
• Free trial periods, if offered, will automatically convert to a paid subscription unless cancelled before the trial ends

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or disassemble any portion of the Service
• Interfere with or disrupt the Service or servers connected to it
• Transmit viruses, malware, or other harmful code
• Create multiple accounts to circumvent restrictions or abuse free trials
• Use automated systems (bots, scrapers) to access the Service without our express permission
• Share, resell, or redistribute your account access to others
• Upload content that is offensive, harmful, or infringes on others’ rights

We reserve the right to suspend or terminate accounts that violate these terms.

Omnutrient is not a substitute for professional medical advice.

• The Service provides general nutrition information and AI-powered suggestions for educational and wellness purposes only
• Nutritional data, calorie estimates, and AI recommendations may not be 100% accurate and should not be relied upon for medical decisions
• Always consult a qualified healthcare professional before making significant changes to your diet, starting a new exercise program, or if you have any health concerns
• If you have a medical condition, eating disorder, food allergy, or are pregnant or nursing, consult your doctor before using our Service
• In a medical emergency, call your local emergency number immediately

Omnutrient uses artificial intelligence to provide nutrition insights, food recognition, and conversational assistance. You acknowledge that:

• AI-generated content is provided “as is” and may contain inaccuracies
• AI responses should be treated as suggestions, not professional advice
• Food recognition and nutritional estimates are approximate and may vary
• We continuously work to improve AI accuracy but do not guarantee error-free results

The Service, including its design, features, content, and underlying technology, is owned by Omnutrient and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

You retain ownership of the content you create within the Service (meal logs, notes, photos). By using the Service, you grant us a limited license to process this content solely to provide and improve the Service.

Omnutrient integrates with third-party services including Apple HealthKit, Strava, WHOOP, Oura, OpenAI, Stripe, and the USDA FoodData Central database. Your use of these integrations is also subject to their respective terms and privacy policies.

We are not responsible for the availability, accuracy, or content of third-party services. Third-party integrations may be modified or discontinued at any time.

You may delete your account at any time through the app (Settings > Account > Delete Account). Upon deletion:

• Your personal data will be permanently deleted within 30 days
• Active subscriptions will be cancelled
• This action is irreversible

We may also suspend or terminate your account if you violate these Terms, with or without notice. In cases of serious violations, we may terminate immediately without a refund.

To the maximum extent permitted by law:

• The Service is provided “as is” and “as available” without warranties of any kind, express or implied
• We do not warrant that the Service will be uninterrupted, error-free, or completely secure
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any health outcomes resulting from following suggestions or information provided by the Service

You agree to indemnify and hold Omnutrient, its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration, to the extent permitted by law.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
